In accordance with Articles L.111-1 et seq. of the French Consumer Code and Article 6 of the French Law for Confidence in the Digital Economy (LCEN). Full legal notices are available on our Legal Notices page.
These Terms of Service ("Terms") govern the access to and use of the Gencara platform, including all products and services offered. By creating an Account or using the Service, you agree to be bound by these Terms, our Privacy Policy, and any additional policies referenced herein.
If you do not agree to these Terms, please do not use the Service.
Gencara is a SaaS platform for AI-powered content creation, including video generation, image generation, AI avatars, voice synthesis, and automatic subtitles. The Service is accessible via a monthly or annual subscription. Gencara also offers a digital training course sold separately or bundled with a subscription.
The Service relies on third-party AI providers for content generation (video, image, voice, and transcription). Features, models, and capabilities may change as providers update their offerings. Gencara does not guarantee the availability of any specific AI model.
To use the Service, you need a modern web browser (Chrome, Firefox, Safari, or Edge), a stable internet connection, and a device capable of playing video and audio content. Gencara is not responsible for performance issues caused by your hardware, software, or internet connection.
6.1. Registration — You must create an Account to use the Service. You agree to provide accurate, current, and complete information. A single Account may be used by more than one person — for example, members of the same team — on any plan. Gencara does not use a per-seat system and sets no limit on the number of users who share an Account; the Account holder remains responsible for all activity under it (see 6.2).
6.2. Security — You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your Account. Notify us immediately at support@gencara.ai if you suspect unauthorized access.
6.3. Age requirement — You must be at least 16 years old to use the Service. If you are between 16 and 18, you must have the consent of a parent or legal guardian.
6.4. Suspension & termination — Gencara reserves the right to suspend or terminate your Account at any time if you violate these Terms, engage in fraudulent activity, or use the Service in a manner that may harm Gencara or other users.
7.1. Plans — Gencara offers three subscription plans: Starter, Creator, and Business. Each plan includes a monthly credit allocation and access to platform features. Prices are displayed in US dollars (USD).
7.2. Billing — Subscriptions are billed in advance, either monthly or annually, depending on the billing cycle you select. The applicable price is the one displayed at the time of subscription.
7.3. Automatic renewal — Subscriptions renew automatically at the end of each billing period (monthly or annually). You will be charged using the payment method on file unless you cancel before the renewal date.
7.4. Payment failure — In the event of a payment failure, a 3-day grace period is granted before your access is suspended. Your access is restored once payment is successfully processed.
7.5. Taxes — The price shown at checkout is the total amount charged; no tax is added to it.
7.6. Secure payment — All payments are processed by Stripe, which is PCI DSS Level 1 certified. Gencara never stores your credit card information. Strong customer authentication (SCA/PSD2) may be required depending on your bank.
8.1. You may cancel your subscription at any time from your Account settings (Settings → Subscription → Cancel). Cancellation is effective in 3 clicks or fewer, in accordance with Article L.215-1-1 of the French Consumer Code.
8.2. Upon cancellation, you retain access to your plan until the end of the current billing period. No prorated refund is issued for an ongoing period.
8.3. Your Generated Content remains accessible for 30 days after your subscription ends. After this period, content stored on our servers may be deleted.
9.1. Credits are consumed when you use generation features (video, image, voice). The number of credits required per generation depends on the AI model, duration, and resolution selected.
9.2. Credits are renewed at the beginning of each billing period. Unused credits do not carry over to the next period.
9.3. Credits are non-transferable, have no monetary value, and are non-refundable (except as part of the subscription refund described in Section 11).
9.4. Gencara reserves the right to adjust credit consumption rates as AI model costs evolve. Any changes will be communicated in advance.
10.1. The Course is a digital product delivered as online streaming video content (non-material digital content).
10.2. In accordance with Article L221-28, 13° of the French Consumer Code, the consumer who expressly agrees to access the Course content immediately and acknowledges the loss of their 14-day right of withdrawal may no longer exercise that right once access has begun (first access to any course module).
10.3. This consent is collected through a separate, unchecked checkbox during the purchase process. The User acknowledges being clearly informed of the loss of their right of withdrawal before completing the order.
10.4. As a result, the Course is non-refundable after first access to the content.
10.5. If the User has not yet accessed the Course content, the 14-day right of withdrawal provided by Article L221-18 of the French Consumer Code applies. Refunds are processed within 14 days.
10.6. The Course provides lifetime access — once purchased, the User can access the content indefinitely, including future updates, regardless of subscription status.
11.1. Gencara offers a 30-day satisfaction guarantee on all subscription plans (Starter, Creator, Business). This guarantee applies from the date of your first subscription purchase.
11.2. To request a refund, email support@gencara.ai within 30 days of your first subscription. The refund covers the most recent monthly subscription payment.
11.3. Bundles (Course + Subscription) — In the event of a bundle refund, only the subscription portion is refundable under the conditions above. The Course portion is retained by the User and is non-refundable in accordance with Section 10.
11.4. The 14-day legal right of withdrawal provided by Articles L221-18 et seq. of the French Consumer Code applies to subscription services independently of the 30-day commercial guarantee.
11.5. Refunds are processed within 14 days via the original payment method.
12.1. The refund guarantee in Section 11 applies to Users acting in good faith, in accordance with Article 1104 of the French Civil Code.
12.2. The following are considered cases of manifest abuse:
12.3. In cases of suspected abuse, Gencara reserves the right to review account usage to assess the good faith of the request before granting a refund.
You agree not to use the Service to:
Violation of this section may result in immediate account suspension or termination without prior notice and without refund.
14.1. Your content — Generated Content created through the Service belongs to you. You may use it for any purpose, including commercial use (ads, social media, client work).
14.2. Our platform — Gencara retains all rights to its platform, software, design, brand, logos, and underlying technology. No license is granted to you other than the right to use the Service as intended.
14.3. License grant — You grant Gencara a non-exclusive, worldwide, royalty-free license to use your Generated Content solely for the purpose of operating and improving the Service (e.g., training quality metrics). Content is processed in anonymized form and never shared publicly without your explicit consent.
15.1. The Service uses artificial intelligence models provided by third parties. AI output quality may vary depending on prompts, models, and external factors beyond Gencara's control.
15.2. Gencara does not guarantee any specific result, revenue, or commercial outcome from using the Service or the Course. Results depend on your effort, content quality, audience, and third-party platform algorithms.
15.3. No refund may be requested on the basis of unmet income expectations.
15.4. You are solely responsible for ensuring that your Generated Content complies with applicable laws and the terms of service of platforms where you distribute it.
The previous affiliate program has ended. Participation in the native partner program requires a new approved application and acceptance of its separately published terms.
17.1. Gencara strives to maintain the Service available 24/7. However, no specific uptime guarantee or SLA is provided.
17.2. Planned maintenance windows will be announced via the platform at least 24 hours in advance when possible. Emergency maintenance may occur without prior notice.
17.3. Gencara is not liable for service interruptions caused by force majeure events (Section 22) or third-party provider outages.
In accordance with Articles L.224-25-12 to L.224-25-26 of the French Consumer Code, digital services and content benefit from a legal guarantee of conformity for two years from the date of supply.
If the Service does not conform to the contract, the consumer may:
The burden of proof regarding the lack of conformity rests with Gencara during the first year following delivery. After this period, the consumer must demonstrate the defect existed at the time of supply.
19.1. The Service is provided "as is." Gencara does not guarantee that the Service will be uninterrupted, error-free, or available at all times. Service interruptions may occur during maintenance, updates, or technical incidents.
19.2. Gencara's total liability is limited to the amount of subscription fees paid by you in the 12 months preceding the event giving rise to the claim.
19.3. Gencara is not liable for any indirect, incidental, or consequential damages, including loss of revenue, data, or business opportunities.
19.4. Gencara is not responsible for the unavailability or malfunction of third-party AI models, payment processors, or hosting services.
Gencara reserves the right to modify these Terms. Users will be notified by email of any significant change at least 30 days before it takes effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
21.1. These Terms are governed by French law. In the event of a discrepancy between the English and French versions of these Terms, the French version shall prevail.
21.2. Amicable resolution — In the event of a dispute, the parties agree to seek an amicable solution before taking legal action. Contact us at support@gencara.ai.
21.3. Consumer mediation — In accordance with Articles L.612-1 et seq. of the French Consumer Code, you have the right to submit any unresolved dispute to a consumer mediator free of charge. You may also use the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.
21.4. If no amicable resolution or mediation succeeds, the dispute shall be submitted to the competent French courts.
Neither party shall be liable for any failure or delay in performing its obligations under these Terms if such failure or delay results from events beyond its reasonable control, including but not limited to: natural disasters, war, terrorism, pandemics, government actions, Internet infrastructure failures, third-party provider outages, or power failures (Article 1218 of the French Civil Code).
23.1. Severability — If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
23.2. Entire agreement — These Terms, together with the Privacy Policy and any additional policies referenced herein, constitute the entire agreement between you and Gencara regarding the use of the Service.
23.3. No waiver — The failure of Gencara to enforce any provision of these Terms shall not constitute a waiver of that provision or the right to enforce it later.
23.4. Assignment — Gencara may assign or transfer its rights and obligations under these Terms in connection with a merger, acquisition, or sale of assets. You may not assign your Account or rights without our prior written consent.
Gencara collects and processes personal data in accordance with the GDPR and the French Loi Informatique et Libertés. We collect only the data necessary to provide the Service (identity, billing, usage, technical data). Your data may be hosted on servers in the United States by our sub-processors, with appropriate safeguards (Standard Contractual Clauses, EU-US Data Privacy Framework).
You have the right to access, rectify, erase, restrict, port, and object to the processing of your data. For full details, see our Privacy Policy.
25.1. Gencara offers a pay-per-view program allowing Users with an Account to earn by posting short-form clips featuring Gencara on third-party platforms (TikTok, Instagram, YouTube), submitting the clip link, and being paid according to verified views. Detailed program rules (including required placement and content-coherence criteria) are set out in the Creator guide, which forms part of these program terms.
25.2. Rate and caps. The payout rate is €2.00 per 1,000 verified views. A clip must have at least 1,000 views to be eligible. Payouts are capped at €600 per clip and €2,000 per creator per calendar month. Gencara may adjust these parameters with notice.
25.3. Advertising disclosure. Clips are paid commercial collaborations. You are responsible for complying with the advertising-disclosure rules that apply to you — including, in France, law no. 2023-451 of 9 June 2023 on commercial influence — and with the branded-content policies of the platform where the clip is published. Each clip must be identified as a paid commercial collaboration using the platform's native disclosure tool (for example TikTok's "Commercial content" toggle, Instagram's "Paid partnership" label or YouTube's "Includes paid promotion" setting) or an equivalent clearly visible on-screen notice.
25.4. Verification and right to refuse. Views are verified automatically and/or manually by Gencara. Gencara may reject a submission at its reasonable discretion, including for: unverifiable or suspicious views; content that does not comply with these Terms, the Creator guide's program rules or the rules of the platform where it is published; missing advertising disclosure (25.3); content that Gencara reasonably considers unsuited to its brand image, target audience or brand-safety standards; or duplicate submissions. Rejections are made in good faith and are notified with a brief statement of reasons. A rejection does not affect earnings from clips already validated whose maturation period has elapsed.
25.5. Earnings, maturation and withdrawals. Validated amounts accrue to a withdrawable balance. Earnings become withdrawable thirty (30) days after the clip is submitted (the maturation period, which is also the review window during which Gencara may refuse the clip). A withdrawal may be requested once the withdrawable balance reaches €25 and is paid in euros (EUR) by manual bank transfer or PayPal. Withdrawal requests are processed manually, typically within seven (7) business days. For bank transfers, the account holder name you provide must match the receiving account (SEPA payee verification).
25.6. Anti-fraud and claw-back. During the maturation period, Gencara may revoke accrued earnings if fraud is discovered (for example purchased or bot views, or a clip removed or reposted in breach of these Terms). The caps above bound the program's exposure.
25.7. Account deletion. If you delete your Account while a withdrawal is pending or a balance is unpaid, you forfeit those amounts. The definitive record of completed payouts is Gencara's bank and PayPal statements.
25.8. Taxes. You are solely responsible for declaring and paying any taxes due on amounts you receive. Depending on your country, payouts to individuals may be subject to reporting obligations.
25.9. Gencara reserves the right to modify, suspend, or terminate the pay-per-view program with 30 days' notice. Amounts already earned and matured remain payable.
